AMC shares are surging after a Delaware judge blocked the company from converting their APE shares into common stock, which would have diluted common shares. The stock is also getting a lift from the strong openings of blockbusters "Barbie" and '"Oppenheimer. Couple of things going on. It came out with attendance figures from the weekend. But also, and probably more importantly for investors, the sinnerman operator was blocked by a Delaware judge from converting its APE preferred shares into common stock. The judge rejected a settlement that would have let the conversion go ahead, while also giving out extra stock to account for the dilution of ordinary shareholders. That was in the deal.

Throughout much of the nineteenth century reports of something variously called the yahoo, hairy man or Australian ape--usually thought of as a remnant of some as yet undiscovered species of Australian animal--regularly emerged from the south-east corner of Australia. For long neglected, these records have in recent years been collected, published and subjected to debate. In the main the difficulty appears twofold--linguistic and epistemological. As for the first, the word 'yahoo', though originally coined by Jonathan Swift, was applied to what was probably the orang-utan in early nineteenth-century England, which may well explain its subsequent though different use in Australia. Secondly, the question of how we may have knowledge of such a creature is as discussed in the concluding paragraph usually answered by a demand that effectively bypasses the real issue. Certainly there are difficulties associated with observational data representing sporadic events of short duration. These, being usually recorded by ordinary people, are seen by scientists as lacking objectivity. In fact we need to take a wider view--such data are statements of an empirical nature and are therefore amenable to scientific enquiry. The real problem is that, whereas causal relationships may be confirmed by experiment or measurement, it appears impossible to verify fleeting, unforeseen events like the sighting of an unknown animal. There is, however, a solution to this problem. Records of such events can be subjected to a test of correlation. In other words, an account is made more probable to the extent that it is confirmed by an independent source. Such a process may like much scientific endeavour be messy and fraught with uncertainty but it presents us with the only method of empirical enquiry suitable to the case in hand.
And there are sort of two sides within the Yahoo ape shareholders now, those who want conversion and those who don't, yahoo ape. Indeed, no historian of Australian science has as much as mentioned him and any assessment of his significance awaits further study. Records of such events can be subjected to a test of correlation.

AMC trading down as the theater company and meme stock officially hit the street with it's APE shares. You could see a red across the board, although there's a lot to kind of unpack here. Recall that what we're talking about here with APE is the preferred stock units that are issued to AMC holders as a special dividend. And what that does for our shareholders is many things. Number one, it takes survival risk off the table in the near term. But we can raise cash if we need it.
